1. Acceptance of Terms

By accessing, browsing, or using the website at https://particlelogo.com ("Site", "Service", or "Platform"), provided by Particle Logo Studio ("we", "us", or "our"), you ("User", "you") agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Particle Logo is an online digital design and motion generation SaaS tool that allows users to:

• Upload brand logo images or graphic assets to sample and compute point clouds and particle coordinates;
• Apply real-time particle dynamic algorithms (such as quantum condense, contour flow, vortex singularity, and typography morphing);
• Export production-ready source code components (Vue 3, React, standalone HTML5) and motion video/GIF files.

3. Account Registration & Security

Some features (including code export, video rendering, and Pro memberships) require you to authenticate via Google Firebase Authentication. You agree to:

• Provide accurate and complete email or profile credentials;
• Maintain the confidentiality of your credentials and account access;
• Promptly notify us of any unauthorized use or security breaches regarding your account.

4. Plans, Billing & Payment Processing

We offer both free tier capabilities and paid subscription/license plans:

• Free Tier: Basic point cloud sampling and online dynamic previews at no charge ($0).
• Monthly Pro Plan: $6.99 USD per month, billed recurringly on a monthly cycle. You may cancel your subscription at any time prior to the next billing date.
• Lifetime Deal: $34.99 USD one-time payment for permanent access to all Pro features and future algorithmic updates.

Payment Provider: All financial payments and billing transactions are securely handled by our authorized third-party payment partner, Waffo (including Waffo Pancake gateway). By initiating a transaction, you agree to comply with Waffo's applicable payment terms and security measures. We do not store or process your complete credit/debit card numbers or CVV codes on our servers.

5. Refund Policy (Money-Back Policy)

Due to the nature of digital goods and immediate software code/asset delivery:

• General Principle: Completed code exports and digital downloads are non-returnable irrevocable digital goods. Once an account has extensively exported source code packages, standard fees are generally non-refundable.
• 7-Day Technical Warranty & Refund Request: If you encounter technical failures or bugs that fundamentally prevent the export of components or animations, and our support team cannot resolve the defect within a reasonable timeframe, you may apply for a full refund within 7 days of the initial purchase.
• How to Request a Refund: Send an email to support@particlelogo.com with your registered email, order/transaction ID, and a description of the issue. Refund requests are processed within 3-5 business days upon verification.

6. Intellectual Property & Commercial Licensing

Your Uploads: You retain 100% full ownership and intellectual property rights in any logo, image, or text you upload to Particle Logo. We claim no ownership over your source trademarks or graphics.

Commercial Use License: Users with active Monthly Pro or Lifetime Deal licenses receive a perpetual, worldwide, royalty-free commercial license to integrate, embed, and deploy the exported particle code (Vue, React, HTML5) and rendered videos in personal, commercial, and client deliverables.

Platform IP: The Particle Logo platform interface, mathematical physics shaders, brand trademarks, and proprietary rendering engine source code are the exclusive property of Particle Logo Studio.

7. Acceptable Use & Prohibitions

You agree not to:

• Upload any content that infringes upon third-party copyrights, trademarks, or proprietary rights;
• Upload abusive, defamatory, obscene, or unlawful materials;
• Attempt to reverse-engineer, decompile, scrape, or overwhelm our API, servers, or web infrastructure;
• Resell, sublicense, or redistribute our SaaS platform itself as a competing generator service.

8. Breach of Terms & Account Termination (Term & Termination)

Remedies for Breach: If you violate any provision of these Terms (including uploading infringing or unlawful content, abusing platform APIs, or engaging in unauthorized reverse-engineering), Particle Logo Studio reserves the right to take any of the following actions at its sole discretion, without prior notice:

• Formal Warning: Issue a written warning detailing the non-compliant behavior;
• Functional Restrictions: Restrict or throttle your access to specific features (such as disabling code export, batch rendering, or typography generation);
• Content Removal: Immediately delete or purge the violating assets, cached data, or associated point clouds;
• Suspension or Termination: Temporarily suspend or permanently terminate your account and revoke your access privileges.

Treatment of Paid Services Upon Termination:

• Termination for Cause (User Breach): If your account is suspended or terminated due to your breach of these Terms, all remaining prepaid subscription periods and lifetime license entitlements will be forfeited immediately without any refund or compensation.
• Voluntary Cancellation: If you voluntarily cancel an active Monthly Pro subscription without breach, your access will remain active until the end of your current paid billing period, and no further recurring charges will occur.

Indemnification & Liability: You agree to defend, indemnify, and hold harmless Particle Logo Studio, its operators, and affiliates against any claims, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or related to your breach of these Terms or your infringement of third-party rights.

Appeals: If you believe your account was suspended in error, you may submit an appeal to support@particlelogo.com within 14 days of the suspension notice.

9. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Particle Logo Studio shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use the Service.

10. Modifications to Terms

We reserve the right to revise or replace these Terms at our discretion. Any material changes will take effect immediately upon posting to this URL. Continued use of the Service following revisions constitutes acceptance of the new Terms.
